The Assyrian Church of the East vs. Bishop Bawai Soro

In today’s preliminary hearing of case # 1-05-CV-054786, the Santa Clara County Superior Court judge granted the plaintiff, the Holy Apostolic Assyrian Church of the East yet another victory over the defendant Bishop Bawai Soro, aka, Ashur B. Soro. The preliminary investigation proved the merits of this case by the strong evidence presented against Bishop Soro. Therefore, the court judge ordered the case to move to a jury trial.

On Monday, February 6, 2006, The Holy Apostolic Assyrian Church of the East will file a request for a date of the upcoming jury trial within the next few months.

Assyrian Church of the East Bishops, His Grace Mar Meelis Zaya, His Grace Mar Odisho Oraham, and His Grace Mar Emmanuel Yosip are very pleased with the outcome of the three days preliminary hearing, because so far the court has granted them 75% of their requests in the law suit.

The Assyrian Church of the East had offered Bishop Soro three options to end the chaos he has created in the Western Diocese, but Bishop Soro’s refusal resulted in his official expulsion from the Assyrian Church of the East. He warned the church authorities and parishioners from entering any of the three churches under his previous administration (Mar Yosip in San Jose, Mar Narsai in San Francisco, and Mar Givergis in Ceres). The renegade Bishop surrounds the three churches by bold street thugs dressed in black to intimidate the church parishioners. The Assyrian Church of the East has also filed a Temporary Restraining Order against Bishop Soro requesting the following:

  1. Assyrian Church of the East authorities’ access to all the churches defrauded by Bishop Soro.
  2. Bishop Soro’s suspension to enter any of the three churches mentioned above.
  3. Bishop Soro to deliver all the church financial records to the plaintiff.

At the end of today’s preliminary hearing, the court judge ordered the followings pending a jury trial:

  1. Bishop Soro to deliver all the financial records, e.g., credit accounts, checking and saving accounts, loans, and bank statements to the Assyrian Church of the East authorities, immediately.
  2. The control and use of Mar Narsai Assyrian Church of the East in San Francisco is granted to the plaintiff, the Holy Apostolic Assyrian Church of the East.
  3. The control and use of Mar Yosip Assyrian Church of the East in San Jose is assigned to the defendant Bishop Soro.
  4. The control and use of Mar Givergis Assyrian Church of the East in Ceres will be divided by both parties on a time-shared-schedule.The Assyrian Church of the East authorities and members of the Holy Synod welcome the opportunity to use the next few months to investigate new discoveries and amend their complaint once they receive and inspect the financial records. Failure to deliver the court ordered financial records to the church authorities will place Bishop Soro in contempt of the court of law.
